Wyche’s commercial real estate practice has been a cornerstone of the firm since its founding over 100 years ago. Our clients include real estate developers, entrepreneurs, banks and other institutional lenders, pension fund advisors, private investment funds and other institutional investors, not-for-profit corporations, governmental agencies, and other domestic and foreign owners of real estate in the United States. We bring extensive experience to a wide variety of sophisticated real estate transactions, including the development, acquisition, disposition, and tax-deferred exchange and contribution of properties, as well as build-to-suit and other leases for retail, commercial, and industrial projects. We are proficient in all aspects of joint venture and partnership transactions that combine financial partners, domestic and foreign, with developers. In addition, our attorneys are skilled in structuring a variety of debt-equity transactions, including real estate financings and sale-leaseback transactions.
Real Estate Acquisition and Development
Our recent work has included build-to-suit transactions for retail, commercial, and industrial use. We have been involved on behalf of private developers in many of the recent high-profile projects that are part of Greenville’s tremendous real estate growth in recent years, including projects at the RiverPlace mixed-used development, a major corporate headquarters campus for one of South Carolina's largest publicly held companies, development of a LEED-certified office and research building on the campus of the Clemson University International Center for Automotive Excellence, and the McBee Station mixed-use project in downtown Greenville.
Real Estate Finance
Our real estate practice also has extensive experience in real estate finance. Wyche’s representation spans the full range of financial legal services including the structuring, negotiation, and documentation of new and refinanced credits, the workout of distressed credits, and the representation of both lenders and borrowers in foreclosure and bankruptcy cases. Our attorneys have successfully concluded transactions involving real estate secured loans, structured financing, and subordinate and mezzanine debt transactions. Our real estate finance clients include many national banks and regional banks that regularly lend to commercial, industrial, multi-family, and specialty real estate owners and developers.
Real Estate Leasing
Our real estate practice includes attorneys with in-depth experience representing landlords and tenants of both single and multi-tenant industrial, office, shopping center and mixed-use properties in a full range of leasing and leasing-related matters, ranging from straightforward leases to complex transactions involving build-to-suit and tax-sensitive transactions.
Real Estate Litigation
Given that real estate is one of the main focuses for the firm, our litigation group has a broad range of experience in handling real estate litigation matters and is well-versed in the unique controversies involving real estate ownership, development, acquisition, disposition, leasing, foreclosures and bankruptcy, as well as matters involving zoning, condemnation, landlord-tenant and easement issues. We have also had extensive experience in dealing with contested title insurance claims, both on behalf of title insurance companies and their insureds.
